A Kindex User is anyone who visits, views, contributes, transcribes, indexes, prints, participates, searches, shares, or uses in any way Kindex software or services, regardless of account status. \n \n 2 User Submitted Records \n 2.01 Record Copyright and Ownership. The decision to create a Kindex Account and upload or share records with Kindex LLC is your responsibility, and you should only submit records that belong to you (or where you have obtained all necessary permissions or consents) and that will not violate the rights of others. Be aware that copyright and other intellectual property rights will normally belong to the creator of the material in question and you should not reproduce or submit anything without permission of the owner. By submitting records to Kindex.org, you represent and warrant that you have the right to do so or that you have obtained any necessary third party consents (e.g., under privacy or intellectual property laws). If you submit material to any of the Websites on behalf of a group, organization or business entity, you represent and warrant that you have the right to do so and that you have obtained any consents from the group, organization or business. \n 2.02 Use License. By submitting records to kindex.org you grant Kindex LLC a perpetual license to host, store, copy, publish, provide access to, create derivative works of (i.e., an index), and otherwise use records submitted by you to Kindex.org, except where prohibited by the designation of a \u201cPrivate Archive\u201d (See \u201cPublic and Private Archives\u201d for limitations). Kindex LLC may image and\/or create a searchable index from the records that are submitted and indexed. \n 2.03 Promotional Use. Kindex must request and obtain permission from the record contributor or Account Administrator to use a record or any derivative thereof for use in any advertising, marketing, blog, or for any other promotional purpose. \n 2.04 Liabilities. You hereby release Kindex LLC from any and all claims, liens, demands, actions or suits in connection with the User Provided Content you submit, including, without limitation, any and all liability for any use or nonuse of your records, claims for defamation, invasion of privacy, right of publicity, emotional distress or economic loss. This license continues even if you stop using Kindex Websites or the Services, so long as the record remains on the Kindex Archive. Record contributors may remove their records and indexed data from the Kindex archive at any time. \n 2.05 Disclosure. You acknowledge and agree that Kindex LLC may preserve any User Provided Content and may disclose any User Provided Content (including its origin) if Kindex LLC believes that it is required to do so by law or that such preservation or disclosure is reasonably necessary to: (a) comply with legal process or governmental requests; (b) enforce the Agreement; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or safety of the Websites, the Users, or the public. \n \n 3 User Submitted Indexing \n 3.01 Indexing. Indexing comprises the act of adding information and descriptions to digital records, transcribing text or audio from digital records, and tagging person names, dates, places, groups, events, subjects, animals, and other details about the record, and posting the information on Kindex.org. By indexing records using Kindex LLC, their Website, or their associates, you grant Kindex LLC a perpetual license to host, store, copy, publish, distribute, provide access to, and create derivative of, and otherwise use the indexed content submitted by you, except where limited by the designation of a Private Archive. \n 3.02 Use of Indexed Data. Kindex Users may not duplicate, extract, make a derivative of, or otherwise copy the indexed contents of a record except by express permission of the record contributor. If permission is obtained, users must fully cite the source of the record and indexed content. Permission to duplicate, download, extract, or copy records or record data does not supercede copyright limitations on the record. Users must obey limitations of copyrighted materials and only extract data from Kindex records through means allowed account administrators through the proprietary Kindex tools. \n \n 5 Public and Private Archives \n 5.01 Public Archives. \n 5.01.01 MyKindex. A MyKindex archive, and its contents, including records and indexed data, is by default private. Records added to MyKindex Archives are not publicly accessible, viewable, or editable except if the record is either 1) imported from a public database, such as FamilySearch, and 2) shared by the user to a public Kindex Archive or other public database or platform. \n 5.01.02 Kindex Family. Kindex Family Archives are by default Public, and their contents viewable, editable, and searchable by Kindex users and other search engines unless otherwise designated as Private by the Kindex Family Account Administrator. Public Archives are: \n 1. Available to any user to search, view, index, share, or print the original record or index thereof. \n 2. Subject to search by 3rd party search engines. \n 3. Listed in a Kindex Directory of Family Archives. \n 5.02 Private Archives. \n 5.02.01 MyKindex. A MyKindex archive, and its contents, including records and indexed data, is by default private. MyKindex records cease to be private when users shares the record with a public Kindex archive or 3rd party archive. \n 5.02.02 Kindex Family. Kindex Family Account administrator may restrict access to view, share, index, or search to invited persons only, designating the archive to be Private. \n 5.02.03 Kindex Projects. Kindex Project Account administrator may restrict access to view, share, index, or search to invited persons only, designating the archive to be Private. \n \n 6 Scope and Restrictions \n 6.01 Permissions. You should submit only content which belongs to you and will not violate the property or other rights of other people or organizations. We are sensitive to the copyright and other intellectual property rights of others. Be aware that content, including photographs, even if submitted to a site of which you are a member, belongs to the creator or submitter and you should not reproduce it without permission of the owner and that photographs of living individuals, except your own minor children, must not be posted without their consent. When creating an audio or voice recording, the personal content recorded should be your own, or if the creation of another, (for example a poem or article), used by permission of the owner. \n 6.02 Appropriate Content. We reserve the right to remove any user provided content which comes to our attention and which we believe, in our sole discretion, is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred, violates the rights of others or otherwise violates this Agreement. Activity that is brought to our attention which appears in our sole judgment to violate the law will be brought to the attention of the proper authorities. \n 6.03 Violations. All records and their derivatives of any type, whether added to Public or Private Archives,must abide by the appropriate content guidelines above. While Kindex does not preview or monitor the submitted records, we may apply, at our discretion, automated filtering tools monitor and\/or remove any content that we believe to be in violation of this Agreement. Repeated violations will result in the suspension of the User Account. \n 6.04 Removing Content. We reserve the right, but do not have the obligation, to act expeditiously to remove or disable access to any User Record Uploads that we believe violates this Agreement.
